DRiBOND Concrete Overlay Solutions, LLC: Product and Service Warranty

DRiBOND Concrete Overlay Solutions, LLC – Limited 10-Year Warranty

This warranty covers all DRiBOND® Products used in residential and commercial installations subject to light traffic that are within the scope of the terms set forth below.  This warranty only applies to DRiBOND® Products that have been used within 3 months of purchase and stored in a cool, dry place.  Exposure to water or excessive humidity prior to application voids any warranty.  DRiBOND Concrete Overlay Solutions, LLC does not guarantee an installer's finished work. DRiBOND Concrete Overlay Solutions, LLC warrants that its Products will be free from manufacturing defects when used in accordance with (a) our technical data sheets and other written instructions in effect on the date of its application or installation, (b) applicable building codes and regulations, and (c) standard industry practices. For purposes of this warranty, DRiBOND® Products currently include: DRiBOND® and the ST300 Screed Tool. It is a condition of warranty coverage that the DRiBOND® Products are used for their intended purpose and that the area and materials used in conjunction with any DRiBOND® Product are properly prepared and of such quality so as to not break or deteriorate when coming into contact with any DRiBOND® Product. No representation, promise, pre-approval, affirmation, statement, or demonstration by any employee or agent of DRiBOND Concrete Overlay Solutions, LLC shall modify or supersede the terms of this warranty.

This limited 10-year warranty is valid for 10 years after date of purchase so long as the application remains unchanged and is non-transferable. The warranty for the DRiBOND® Product purchased is only covered up to the actual price paid by the consumer for the DRiBOND® Product, proof of purchase required, and does not cover the cost of installation, application or replacement of any pavers, tile installed, or other material used in conjunction with any DRiBOND® Product. To the extent permitted by law, all other warranties, including, but not limited to, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXCLUDED. ANY IMPLIED WARRANTIES ARISING BY OPERATION OF LAW ARE LIMITED IN DURATION TO THE TERM OF THIS EXPRESS LIMITED WARRANTY, but some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty: (a) shall commence on the date of purchase of the DRiBOND® Product and shall end as specified in this warranty; (b) is limited to the original user and is non-transferable; (c) replaces all previous warranties; (d) applies only to specified DRiBOND Concrete Overlay Solutions, LLC Products used on the original application or installation; (e) applies so long as the Products application remains unchanged from its initial installation; and (f) applies only to product(s) purchased and installed within the United States on or after October 5, 2023. The substitution, alteration, or addition of any foreign matter or material to a DRiBOND® Product will void this warranty.

DRiBOND Concrete Overlay Solutions, LLC will not be liable for damage or loss resulting from the following: structural failure; inadequate surface or sub-surface; improper preparation of concrete or substrate; Acts of God, including, but not limited to hurricane, flooding, earthquake, or other types of natural disasters; product misuse or abuse; failure to comply with our technical data sheets or other written instructions, applicable building codes or regulations, or standard industry practices; efflorescence and shading inherent in all cementitious products; surface or substrate moisture or damage; wear and tear from normal usage; cracking due to structural movement, excessive deflection, or other failure of the substrate; and failure to store, use, install, cure, or maintain the product in strict accordance with our specifications and instructions.  This Warranty does not cover the costs of installation or application nor the cost of any pavers, tiles, or other product or material used with any DRiBOND® product but is limited to the actual purchase price of the DRiBOND® product, with proof of purchase required.  It has been noted that the use of DRiBOND® Products on newly poured and not fully cured concrete may tend to pull coloring and chemicals from the newly poured concrete.  For this reason, it is not recommended that DRiBOND® Products be used on concrete surfaces that are less than six (6) months old.  DRiBOND should not be used in subaqueous conditions and is not intended for applications that are prone to extended water submersion.  DRiBOND® does not warrant the color or shading of its product as this can change due to efflorescence, humidity, cure time, materials used in conjunction with DRiBOND® Products and other factors.

If our products are proven defective within this warranty, DRiBOND Concrete Overlay Solutions, LLC will provide replacement product for only the specific portion of the original installation requiring replacement. Efflorescence is a normal occurrence with cementitious products and is not a defect. This shall be your sole and exclusive remedy. IN NO EVENT SHALL DRiBOND Concrete Overlay Solutions, LLC BE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF SALES OR PROFITS; BUSINESS INTERRUPTION OR DOWNTIME; INCREASED EXPENSE OF OPERATION; DAMAGE TO OTHER MATERIALS OR PROPERTY; OR LOSS OF USE OF PROPERTY. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
